Joint Check Agreement | |
This Agreement is entered into by and between the following parties:
as owner (“Owner”)
as contractor (“Contractor”)
as supplier or Seller (“Seller”):
FOR VALUABLE CONSIDERATION, the receipt and sufficiency of which is hereby acknowledged, Owner, Seller and Contractor agree as follows:
- Checks issued by Owner to Contractor for materials supplied by Seller on the construction project (“Project”) shall be made jointly payable to Contractor and Seller. These checks shall be delivered to Seller.
- Owner may obtain from Seller a statement stating the total current indebtedness of Contractor to Seller.
- Owner may limit additional purchases by Contractor from Seller on the project at any time.
- Owner hereby guarantees the payment of sums justly due from Contractor to Seller for the project for materials supplied to the Project.
